Terms of Service - modus marine

By creating an account or using modus marine (the "Service"), you agree to these terms. If you don't agree, don't use the Service.
1. Who you're contracting with
The Service is provided by its independent developer ("we", "us") - an individual, not a company. The app is in private testing and every account was created by invitation, so the route to us is a direct reply to whoever gave you access. An operating entity and a published contact address will be named here before the Service is offered publicly, and you will be told before that change takes effect (§11).
2. What the Service is - and isn't
modus marine is operational memory and maintenance scheduling for cruising and charter yachts (30-80ft). It tracks your equipment, services, projects, calendar, and documents, projects service due-dates from hour readings, and produces a weekly summary you can share with an owner.
modus marine is not a substitute for the captain's judgment. It does not inspect equipment, perform maintenance, or make safety decisions. Anything the app projects (e.g. "next service in N hours") is a calculation from the data you've entered and the run-rate it observes - verify against the actual condition of the equipment and the manufacturer's manual before acting.
The Service is not classified, certified or warranted as fit for any safety-of-life application. Authoritative records (e.g. for survey, insurance, or flag-state purposes) remain your responsibility.
3. Your account
You need to be at least 18 and legally able to enter a contract.
You are responsible for:
- the accuracy of what you enter,
- keeping your password and any onboard devices secure,
- the activity that happens under your account.
If you suspect a compromise, change your password immediately and contact us.
4. Acceptable use
You agree not to:
- use the Service for anything illegal, fraudulent, or harmful,
- upload content you don't have the right to upload (including personal data about crew, owners, or contractors without an appropriate basis - see the Privacy Policy, §10),
- upload malware, attempt to compromise the system, or interfere with other users' access,
- scrape or reverse-engineer the Service except as expressly permitted by applicable law.
We may suspend or terminate accounts that breach this, with notice where reasonable.
5. Your data
You retain ownership of the data you enter (vessel records, equipment, services, projects, documents, photos, etc.) - "Your Content".
You grant us a limited licence to host, store, process, transmit and display Your Content for the sole purpose of providing the Service to you (and, where you direct it, to recipients you nominate - e.g. the weekly report to an owner).
We will not sell Your Content, share it with third parties for marketing, or use it to train AI models.
6. Our service
We aim to keep the Service available, reasonably performant, and current. The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose, except to the extent required by law.
We may change, suspend, or discontinue features with reasonable notice. For material breaking changes we will notify you in-app or by email at least 30 days in advance and provide an export route for Your Content.
7. Fees
The Service is free while it is in private testing. There is no payment system in the app, we hold no card details, and nothing you do here can incur a charge.
If a paid plan is introduced, its terms - the amount, the billing cycle, refunds, what happens at the end of any trial, and what happens to Your Content if you stop paying - will be set out here and notified to you at least 30 days beforehand (§11). You will never be charged for a plan you did not choose.
8. Termination
You can delete your account at any time from Settings, in the app. On deletion, we will hard-delete the personal data we hold about you within a reasonable period (see Privacy Policy, §6) and will instruct our subprocessors to do the same.
We may terminate or suspend your account for material breach of these terms, non-payment, or where required by law. We will give reasonable notice and a chance to remedy where practical.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law:
- The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for indirect, incidental, consequential, special, or punitive damages; loss of profit, revenue, data or goodwill; or any damage arising from a decision you took (or didn't take) based on what the Service showed you.
- Our total aggregate liability for any claim arising under or related to these terms is capped at the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. While the Service is free, (a) is nil and the cap is USD 100.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded (e.g. for fraud, death or personal injury caused by negligence, or breach of statutory consumer rights).
10. Indemnity
You agree to indemnify us against third-party claims arising from Your Content, your breach of these terms, or your misuse of the Service.
11. Changes to these terms
We may update these terms. Material changes will be notified at least 30 days before they take effect. Continued use after that means you accept the update; if you don't agree, stop using the Service and delete your account.
12. Governing law and disputes
While the Service is in private testing and provided free of charge, we do not designate a governing law or an exclusive forum. Mandatory consumer-protection law in your own country applies to you in full, and nothing in these terms limits it or moves you away from the courts it gives you.
A governing law and forum will be stated here before the Service is offered publicly, and you will be told at least 30 days beforehand (§11).
13. Contact
Reply to whoever gave you access to the app (§1). A published contact address replaces this line before the Service is offered publicly.
